Types of Restraining Orders
California courts recognize four different types of restraining orders. Depending on your circumstances and needs, our attorney can help choose which of these orders best suits you. If you have one of these orders placed against you, we can help you understand the restraints and create a legal strategy to remove the order.
The four California restraining orders include:
- Domestic Violence Restraining Order
- Civil Harassment Restraining Order
- Elder or Dependent-Adult Abuse Restraining Order
- Workplace Violence Restraining Order
Obtaining a Restraining Order
Most people who need a restraining order will opt for either a domestic violence restraining order or a civil harassment order. A domestic violence restraining order can help protect you from a spouse, romantic partner, blood relatives, and anyone else you share an intimate relationship with. If you do not share an intimate relationship with the person you need protection from, you will need to file a civil harassment order.
How Can a Restraining Order Protect Me?
Restraining orders can be used to prevent your potential abuser from harming you. Once effective, the order will prohibit that person from approaching you, contacting you, visiting your place of work, visiting your home, approaching your school, stalking you, contacting you on social media, and more. Depending on the type of order you use, the stipulations may vary.
At the first sign of trouble, you'll want to request an EPO or an Emergency Protective Order. These orders are fast-acting and can be set in place when law enforcement directly contacts a judge. Once ordered by the judge, EPOs can take effect immediately and can last up to 7 days. At that point, the petitioner must ask for a Temporary Restraining Order (TRO).
To obtain a TRO, you must provide the court with adequate paperwork showing why the restraining order is necessary. The order can last up to 25 days. If you need long-term protection, you may choose to ask the judge for a Permanent Restraining Order when you attend your TRO court hearing. If a permanent order is ordered, it can last up to 5 years.
Not sure which type of order is for you? Our Encino-based firm can help determine the best course of action for you and your family. Whether you are dealing with a spousal abuse situation, a stalker, a contentious ex-boss, or any other issue that causes you to fear for your safety, we want to help you seek legal recourse.
Defending Against a Restraining Order
Family matters are, by nature, exceedingly complex and subjective. While restraining orders protect countless survivors of abuse and help protect innocent individuals against dangerous threats, some orders are based on false accusations and fabricated evidence. Our attorney firmly believes in fair legal representation, and if you are facing a restraining order, we want to help protect your rights and serve your legal interests.
Restraining orders can jeopardize your relationship with your children, take away parenting time, and it could impact your child custody agreement. Even if you do not have children, a restraining order could affect your personal relationships and your residence. If you can no longer return to your family home, you will need to find a new place to live, which can have serious financial repercussions.
We encourage you to reach out to our skilled Encino restraining order attorney at Akbarian Law Group, APLC to avoid these issues.
