PATERNITY

ESTABLISHING PATERNITY AND PROTECTING PARENTAL RIGHTS

Paternity is the legal establishment of a child's biological father, a process that can often become heated and emotional due to its significant implications. Paternity actions typically arise in situations involving child support, adoption, inheritance, child custody and visitation, and healthcare. Establishing paternity is crucial for ensuring that a child's rights and well-being are protected. It also clarifies and secures the rights and responsibilities of both parents, which can have long-lasting impacts on the child's life and the parents' futures.

How to Establish Paternity

In California, if a woman is married when she has a child, her husband is presumed to be the father. However, this presumption can be disputed in court within two years of the child's birth. If the mother is not married at the time of conception or birth, a man can voluntarily sign and file a declaration of paternity to establish his legal fatherhood. This voluntary declaration has the same legal effect as a court order of paternity.

In cases where there is a dispute over who the biological father is – and who consequently has the legal obligation to support the child financially – the court will typically order the alleged father to complete a DNA test. This test is administered by a court-appointed expert to ensure accuracy and fairness in the determination of paternity.

The Benefits of Establishing Paternity

Establishing paternity provides several significant advantages for mothers, fathers, and children alike. Although the process can be emotionally challenging, it is crucial for ensuring that all parties can exercise their rights and receive the support they need. The benefits of establishing paternity include:

  • Financial and Parenting Support for Mothers: Establishing paternity legally obligates the biological father to provide financial support, helping mothers with the costs associated with raising a child. Additionally, it can ensure that fathers share parenting responsibilities.
  • Parental Rights for Fathers:  Fathers who establish paternity gain legal recognition of their parental rights, enabling them to seek custody, visitation, and the ability to make important decisions about their child's upbringing.
  • Understanding Family Medical History for Children: Knowing their biological father's identity allows children to have a complete understanding of their family’s medical history, which is vital for their health and well-being.
